By accessing or using Ombir AI, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use the platform.

If you use Ombir AI on behalf of a business, you confirm that you are authorised to accept these terms for that business.

Ombir AI provides a WhatsApp CRM and communication management platform, including AI voice and chat agents, contact and conversation management, campaign tooling, analytics and related integrations.

We may add, modify, or discontinue features at any time to improve or maintain the service.

You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity carried out under your account.

Notify us immediately if you suspect unauthorised access to your account.

You agree not to use Ombir AI to:

• Send spam, unsolicited, misleading, or unlawful messages
• Harass, threaten, defraud, or impersonate any person or organisation
• Upload malicious code or attempt to disrupt or reverse engineer the platform
• Access data or accounts you are not authorised to access
• Violate any applicable law, regulation, or third-party right

Where you connect WhatsApp or other Meta services to Ombir AI, you must comply with all applicable Meta and WhatsApp policies, including the WhatsApp Business Messaging Policy and Meta Platform Terms.

You must hold appropriate authorisation and opt-in consent for every contact you message and for all customer data you process through Ombir AI. We may suspend access to integrations where policy violations are suspected or reported.

You remain the controller of the customer and contact data you upload or generate on the platform. You are responsible for the lawfulness of that data, including obtaining consent, honouring opt-outs, and responding to the rights requests of your own customers.

Ombir AI processes this data on your instruction to deliver the service.

Our handling of personal information is described in our Privacy Policy, which forms part of these terms. You can request deletion of your data at any time through our Data Deletion page.

Ombir AI relies on third-party providers such as Meta and WhatsApp APIs, cloud hosting, AI model providers, and analytics tools. Your use of those services may also be subject to their own terms, and we are not responsible for their availability or actions.

All software, design, branding, documentation and content of the Ombir AI platform are owned by Ombir AI or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the platform in line with these terms.

Content and data you upload remain yours.

We aim to keep Ombir AI available and reliable, but the service may be interrupted by maintenance, upgrades, third-party outages, or events outside our control. We do not guarantee uninterrupted or error-free operation.

The platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, Ombir AI shall not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or business opportunities arising out of your use of the platform.

We may suspend or terminate your access if you breach these terms, violate Meta or WhatsApp policies, create security or legal risk, or fail to pay applicable fees. You may stop using the service and request account closure at any time.

We may update these Terms of Service from time to time. The revised version will be published on this page with an updated “Last Updated” date, and continued use of the platform means you accept the updated terms.

These terms are governed by the laws of India. Courts located in Kolkata, West Bengal shall have exclusive jurisdiction over any disputes arising from these terms or your use of Ombir AI.
